HomePilot Limited Plant & Flower Warranty

Effective Date: August 1, 2026

HomePilot takes pride in providing healthy, professionally selected and installed plant material. Because plants are living organisms affected by weather, watering, soil conditions, irrigation, pests, disease, maintenance, and other conditions outside of HomePilot's control, all plant material is subject to the following Limited Plant & Flower Warranty.

This Limited Warranty applies only to qualifying plant material supplied and installed by HomePilot and is subject to all terms, conditions, exclusions, and customer responsibilities described below.

1. Warranty Periods

Unless a HomePilot quote or invoice expressly states otherwise, the following warranty periods apply beginning on the original installation date:

Annual flowers and seasonal color are guaranteed to be healthy and in acceptable condition at the time of installation but are not guaranteed for any period following installation.

Sod, seed, turf, and other products not specifically listed above are not covered by this Limited Plant & Flower Warranty unless expressly stated otherwise in writing by HomePilot.

2. What This Limited Warranty Covers

During the applicable warranty period, HomePilot warrants qualifying plant material against complete plant failure resulting from:

  • A material defect that existed at the time the plant was supplied;
  • A nursery-related condition that was not reasonably apparent at the time of installation; or
  • Improper installation performed by HomePilot.

A plant must be determined by HomePilot to be dead or unlikely to recover before replacement is authorized.

Temporary transplant shock, leaf drop, reduced flowering, discoloration, seasonal dormancy, minor dieback, temporary wilting, or other normal plant responses do not by themselves constitute plant failure.

HomePilot does not guarantee a specific rate of growth, flowering schedule, flower quantity, flower color intensity, mature size, shape, foliage density, or other aesthetic characteristic of a living plant.

3. Customer Care Responsibilities

Warranty coverage requires the customer to provide reasonable and appropriate care for the installed plant material.

This includes providing appropriate watering, maintaining functioning irrigation where irrigation is used, preventing prolonged overwatering or underwatering, and following any care instructions provided by HomePilot.

Customers are responsible for monitoring newly installed plants and promptly notifying HomePilot if a plant begins showing signs of significant decline.

Customers may not knowingly allow a plant to continue declining for an extended period and then request replacement after the plant has died if earlier notification could reasonably have allowed corrective action.

HomePilot does not require customers to purchase ongoing maintenance services from HomePilot in order to maintain warranty coverage.

4. Watering and Irrigation

Proper watering is critical to newly installed plant material.

The customer is responsible for ensuring that each plant receives adequate water following installation. Automatic irrigation systems must be functioning properly and providing appropriate coverage to the plant's root zone.

Plant loss caused in whole or in part by any of the following is excluded from warranty coverage:

  • Insufficient watering;
  • Excessive watering;
  • Irrigation system failure;
  • Broken, clogged, misdirected, or improperly adjusted irrigation components;
  • Water restrictions;
  • Extended periods during which irrigation is turned off;
  • Standing water or chronically saturated soil; or
  • Other improper irrigation or watering practices.

HomePilot may inspect irrigation coverage as part of evaluating a warranty claim.

5. Conditions Not Covered

This Limited Warranty does not cover plant damage, decline, or death caused directly or indirectly by circumstances outside HomePilot's reasonable control, including but not limited to:

  • Freeze, frost, extreme cold, or winter weather;
  • Extreme heat or prolonged high temperatures;
  • Drought;
  • Hail;
  • High winds;
  • Tornadoes;
  • Severe storms;
  • Flooding;
  • Lightning;
  • Fire;
  • Natural disasters or acts of God;
  • Government watering restrictions;
  • Poor drainage;
  • Standing water;
  • Soil contamination;
  • Unusual soil chemistry or deficiencies;
  • Rock, construction debris, concrete, or other subsurface conditions;
  • Changes in drainage or grade after installation;
  • Insects;
  • Disease occurring after installation;
  • Fungal conditions;
  • Wildlife;
  • Deer;
  • Rabbits;
  • Rodents;
  • Pets;
  • Vandalism;
  • Theft;
  • Vehicle damage;
  • Lawn equipment;
  • String trimmers or weed eaters;
  • Mowers;
  • Construction activity;
  • Utility work;
  • Excavation;
  • Herbicides;
  • Pesticides;
  • Fertilizers;
  • Chemicals;
  • Improper pruning;
  • Improper maintenance;
  • Neglect;
  • Abuse;
  • Alteration of the planting area;
  • Relocation of the plant after HomePilot installation; or
  • Actions or omissions of the property owner, occupants, tenants, guests, other contractors, landscapers, lawn-care providers, irrigation providers, or third parties.

6. Site Conditions and Customer-Selected Plants

HomePilot will make reasonable efforts to recommend plant material appropriate for the installation location.

However, the customer remains responsible for decisions to proceed with a specific plant or location after HomePilot advises that the plant may not be appropriate because of sunlight, shade, drainage, available space, soil conditions, exposure, irrigation, climate, or other site conditions.

If the customer requests that HomePilot install a plant contrary to HomePilot's documented recommendation, HomePilot may designate the plant as non-warrantable on the applicable quote, work order, or invoice.

7. Existing and Transplanted Plants

HomePilot may relocate or transplant existing plants at the customer's request.

Because HomePilot cannot control the plant's prior health, root structure, previous planting method, stress history, disease exposure, or previous care, existing plants that are transplanted, relocated, divided, or otherwise disturbed are not guaranteed to survive and are not covered by this Limited Warranty.

HomePilot will use reasonable professional care when transplanting existing plants but makes no guarantee regarding survival.

8. Customer-Supplied Plants

Plants purchased or supplied by the customer or another third party are not covered by HomePilot's plant warranty.

HomePilot may install customer-supplied plant material when agreed upon, but HomePilot's responsibility is limited to reasonable workmanship associated with the installation itself.

9. Annuals and Seasonal Flowers

Annual flowers and seasonal color, including plants typically intended for one growing season, do not carry a survival warranty.

HomePilot warrants only that such plants will be reasonably healthy and suitable for installation at the time they are installed.

Subsequent decline or death due to environmental conditions, temperature, watering, seasonal changes, pests, disease, or other conditions is not covered.

10. Making a Warranty Claim

A warranty claim must be submitted before expiration of the applicable warranty period.

Customers should contact HomePilot using the contact information provided on their quote, invoice, or at homepilotco.com.

The customer may be asked to provide:

  • Customer name;
  • Property address;
  • Original quote or invoice information;
  • Description of the affected plant;
  • Photographs of the affected plant and surrounding planting area; and
  • Information regarding watering and irrigation.

The affected plant must remain installed at the original installation location until HomePilot has had a reasonable opportunity to inspect or evaluate it.

Do not remove or discard a plant for which a warranty claim will be made unless HomePilot provides authorization. Removal or disposal of a plant before HomePilot can reasonably evaluate the condition may result in denial of the warranty claim.

11. Early Notification Requirement

Customers should notify HomePilot as soon as significant decline becomes apparent.

Whenever practical, HomePilot reserves the right to inspect the plant, recommend corrective watering or maintenance, treat the condition, adjust the plant, or take other reasonable corrective action before determining that replacement is necessary.

Failure to provide HomePilot a reasonable opportunity to diagnose or attempt to correct an issue may affect warranty eligibility.

12. Warranty Remedy

For a valid warranty claim, HomePilot may, at its discretion:

  • 1. Attempt corrective treatment or care;
  • 2. Replace the affected plant with the same plant or a reasonably comparable plant; or
  • 3. Provide a HomePilot credit not exceeding the original amount paid for the affected plant.

If HomePilot elects to replace the plant, standard removal, delivery, and reinstallation of the replacement plant are included.

Additional work required to correct conditions that caused or contributed to the original plant failure—including drainage correction, irrigation repair, soil replacement, soil amendment, grading, excavation, utility work, bed reconstruction, or other site modifications—is not included and may be quoted separately.

Cash refunds are not required under this Limited Warranty unless HomePilot elects to provide one or applicable law requires otherwise.

13. Replacement Plant Availability

Replacement of the exact plant species, cultivar, color, or size is subject to nursery availability.

If an identical replacement is unavailable, HomePilot may provide a reasonably comparable plant of similar type and value or provide an appropriate credit.

The customer may elect a more expensive replacement plant by paying the difference in price.

14. Timing of Replacement

HomePilot may delay replacement when immediate planting would create an unreasonable risk of failure due to extreme heat, freezing temperatures, drought, weather conditions, seasonal availability, or other horticultural considerations.

A valid warranty claim submitted during the warranty period remains valid if HomePilot determines that replacement should occur during a more appropriate planting period.

15. One-Replacement Limit

This Limited Warranty provides a maximum of one replacement per originally installed plant.

Replacement of a plant does not restart or extend the original warranty period.

Any remaining warranty coverage continues only through the expiration date of the original plant's warranty period, and the issuance of a replacement does not create an additional replacement entitlement.

16. Maximum Warranty Liability

To the extent permitted by applicable law, HomePilot's maximum liability under this Limited Warranty will not exceed the amount originally paid to HomePilot for the affected plant or affected plant installation.

HomePilot is not responsible under this Limited Warranty for incidental, indirect, special, or consequential losses resulting from plant failure, including loss of use, loss of enjoyment, diminished property value, replacement landscaping performed by another contractor, or other consequential expenses, except to the extent such limitations are prohibited by applicable law.

17. Implied Warranties and Legal Rights

This document describes HomePilot's express Limited Plant & Flower Warranty.

To the extent permitted by applicable law, any implied warranties applicable to the covered plant material are limited in duration to the applicable express warranty period stated in this Limited Warranty.

Nothing in this Limited Warranty is intended to eliminate or restrict any right or remedy that cannot legally be waived or limited under applicable federal, state, or local law.

Customers may have additional legal rights that vary by jurisdiction.

18. Non-Transferable Warranty

This Limited Warranty applies only to the original HomePilot customer and the property at which HomePilot originally installed the plant material.

Warranty coverage may not be transferred to a subsequent homeowner, property owner, tenant, purchaser, or other party unless HomePilot expressly agrees otherwise in writing.

19. Quote-Specific Warranty Terms

A HomePilot quote, proposal, work order, or invoice may expressly provide different warranty coverage for a specific plant or project.

When a project document expressly identifies a different warranty period or identifies particular plant material as non-warrantable, the project-specific written terms will control for that plant or project.

Verbal representations do not modify this Limited Warranty.

20. Acceptance of Warranty Terms

By purchasing qualifying plant material from HomePilot and approving the associated quote or proposal containing a reference or link to this Limited Warranty, the customer acknowledges that the warranty terms were made available before purchase and accepts the terms applicable to the plant installation.

21. Governing Law

This Limited Warranty is governed by applicable federal law and the laws of the State of Texas, without limiting any consumer right that cannot legally be waived.
